Terms of Service

Draft version — last edited [date]
⚠️ This is a starting draft, not a finished legal document. Have a lawyer review this before publishing — especially the liability, refund, and "no financial services" sections, which are the ones most likely to matter if a dispute ever arises between stokvel members.

1. What Stokvel Chommie is

Stokvel Chommie is software that helps a stokvel's treasurer and members track contributions, payout schedules, and confirmations. It is a record-keeping and coordination tool.

2. What it is not

Stokvel Chommie does not hold, move, or process members' money. It is not a payment processor, escrow service, or financial institution. All actual payments happen directly between members — bank transfer, cash, or however your group already handles money. We are not a party to, and take no responsibility for, the underlying financial transactions between members.

3. Accounts and access

The treasurer (or site admin) is responsible for accurately entering member details and correctly configuring the stokvel. Members access their view via a magic link sent to the email address the treasurer provides — it is the treasurer's responsibility to enter correct email addresses.

4. Accuracy of records

The "dual confirmation" and audit trail features are designed to reduce disputes, but they only record what both parties confirm through the software — they do not independently verify that a bank transfer or cash payment actually occurred. Groups remain responsible for reconciling the software's records against their actual bank statements or cash counts.

5. Licence fees, hosting & payment

Stokvel Direct, Hosted, and DIY plugin licence fees are all billed monthly as recurring subscriptions via PayFast, as described on our pricing page. Any once-off setup or custom development work is invoiced separately at the time it's agreed. [Insert your specific refund policy, cancellation terms, and billing cycle details here once finalised.]

6. Limitation of liability

[This section needs a lawyer's input specific to your jurisdiction and business structure. At minimum it should address: liability for software downtime or bugs, liability for a member's mishandled payment outside the software, and any cap on damages.]

7. Changes to these terms

We may update these terms from time to time. Material changes will be communicated to active licence holders.
